1. Introduction

Welcome to Chess3, a web3-based chess game developed and managed by ONCHAIN GAMES PTY LTD (the “Company”), a company registered in Queensland, Australia (ABN: 63 669 448 962). This document, referred to as the “Terms and Conditions,” outlines the rules and guidelines governing your use of our services. Users may also connect other existing wallets to their Chess3 account. The user assumes full responsibility for managing and securing their wallet(s), including keeping private keys, passwords, and other related information secure.

3. Wagering and Earnings

3.1 Wagering: Chess3 allows users to wager on their own games using crypto or fiat currencies. Users must have sufficient funds in their connected wallets to place a wager. Wagers are confirmed and cannot be cancelled once placed. Wagering is deemed a commitment to play the game to completion.

3.2 Earnings and Losses: Any earnings derived from a game where a wager was placed will be credited to the user’s connected wallet. Conversely, losses will be debited from the same wallet. The transfer of funds is automatic and irrevocable.

3.3 Disclaimer: The Company does not bear any responsibility for decisions made by users regarding wagers, including the decision to participate in wagering. Users acknowledge that wagering involves risk, and potential losses cannot be offset against the Company. We urge all users to wager responsibly.

4. Fees and Commissions

4.1 Fee Structure: ONCHAIN GAMES PTY LTD levies various fees and commissions for services provided on the Chess3 platform. These include match fees, which are fixed charges applicable to every match played, and commissions on any wagers made.

4.2 Transaction Fees: For every transaction conducted on the platform, whether it involves the exchange of fiat currency, cryptocurrency, or non-fungible tokens (NFTs), a transaction fee will be charged. The fee amount will be deducted directly from the user’s connected wallet.

4.3 Platform Fees: The company reserves the right to charge a platform fee for the use of the Chess3 system. This fee supports the maintenance and improvement of the platform.

5. Non-Fungible Tokens (NFTs) and Property Rights

5.1 NFT Availability and Ownership: Users may occasionally have the opportunity to purchase, win, or otherwise obtain unique NFTs representing chess boards or chess pieces. Once obtained, these NFTs are the property of the user and can be transferred, traded, or sold to other users.

5.2 Intellectual Property: All intellectual property rights related to the Chess3 platform, including but not limited to the platform’s design, graphics, text, software, code, and other content, belong to ONCHAIN GAMES PTY LTD, except for NFTs owned by users. Unauthorized use, copying, reproduction, or modification of any of these properties without prior written consent from the Company is strictly prohibited.
